PLAMEDLL · DOCUMENT 05
Copyright and Intellectual Property.
This policy explains the ownership and permitted use of original artwork created through Plamedll.
1. Copyright Ownership
Unless a separate written agreement expressly provides otherwise, Plamedi Otiom retains copyright in the original artwork created for a Plamedll commission, subject to applicable copyright law.
Payment for a commission does not automatically transfer copyright ownership to the customer.
2. Customer's Personal-Use Permission
After the commission has been paid in full, the customer receives a non-exclusive permission to possess, display, and enjoy the delivered artwork for personal, non-commercial purposes.
This permission allows the customer to display the original artwork in their home or personal space and share reasonable personal photographs of it, provided the sharing does not imply commercial endorsement or ownership of Plamedll's copyright.
3. Uses Requiring Written Permission
Customers must obtain separate written permission before:
- Producing merchandise or products using the artwork.
- Selling prints, reproductions, or commercial copies.
- Licensing the artwork to another person or business.
- Using the artwork in paid advertising or commercial branding.
- Claiming authorship of the original drawing.
- Distributing copies for commercial purposes.
4. Artist Attribution
Customers are welcome to credit Plamedll when sharing the artwork. Attribution is appreciated, although personal sharing does not require a separate promotional consent selection.
5. Reference Photographs
Customers may provide photographs as references for their commissions. The copyright in those photographs generally belongs to the photographer or other rights holder, not automatically to the customer or Plamedll.
The customer must have appropriate permission or another lawful basis to provide the photograph for the requested commission. Plamedll does not claim ownership of the customer's reference photograph.
6. Images of Other People
If a reference photograph depicts another person, the customer is responsible for addressing any necessary permissions for commissioning the drawing. Any public use of the depicted person's identifiable likeness may require separate consent, regardless of the customer's permission concerning the artwork.
7. Promotional Publication
Plamedll's right to retain copyright is separate from permission to publish a customer's identifiable commissioned artwork. Promotional publication is governed by the separate Portfolio and Marketing Consent Policy and the customer's recorded choice.
8. Copyright Transfers and Commercial Licenses
A customer who wishes to purchase copyright ownership, an exclusive license, or broader commercial rights must contact Plamedll to discuss a separate written agreement. Any transfer or license must clearly identify the rights, uses, territory, duration, and compensation agreed upon.
9. Copyright Questions
For permission requests, licensing inquiries, or concerns about intellectual property, contact Plamedll.
